Your Check Is Not In Yet!!

When clients become impatient waiting for their money

settlement checkI often receive calls from clients after their case has been settled and after they have signed a release wanting to know when they will get their check. These calls come from any time from one day after they signed the release up until the time that the check arrives from the insurance company. Clients should understand that attorneys want to get these checks as fast as they can because we don’t get paid until the check comes in either!  Many times, when dealing with non-standard insurance companies, it is not uncommon for me to have to call the insurance adjuster several times after I have returned the signed release to them to inquire as to the whereabouts of the settlement check. I am not sure if this is a stall tactic that these companies like to play or if the adjusters simply forget to mail out the checks, but I am here to tell you that it is not my fault that the check is not here!  I make every effort to do my job diligently and make the process go as quickly and smooth as possible. However, certain aspects of the speed of which a claims are resolved are not in my control. Once I have all of a client’s medical records and bills in the file, I get the file out to the insurance adjuster immediately. At this point, I am waiting for the adjuster to review the file and make a settlement offer. Once the case is settled and I have returned the signed release to the insurance company, I am waiting on the adjuster to issue and mail me a settlement check. Unfortunately, I along with all other personal injury attorneys cannot control when insurance adjusters will do their jobs.  My advice to all clients is to be patient. Your attorney is doing all he or she can to settle your case and get your settlement check. In certain cases there might be an unusually long delay in either settling a case or receiving a settlement check, but rest assured that I am doing everything I can to bring your case to resolution and get you the money owed to you from the settlement of your claim.
