Don’t Give Insurance Companies Recorded Statements Following A Car Accident If You Plan On Hiring An Attorney

Why you should not speak to opposing party's insurance company following an accident before speaking with an attorney

Many auto insurance companies will contact the adverse party involved in an accident with their insured very shortly following an automobile accident. They will ask a myriad of questions about how the accident happened, injuries that were sustained, treatment at a hospital or doctor’s office and many other questions in great detail so that they can evaluate the merits of your claim. DO NOT TALK TO THE OTHER INSURANCE COMPANY UNTIL YOU CONSULT WITH AN ATTORNEY!!! Most importantly, do not allow them to record your statement. You may ask why should I not speak with these people, aren’t they trying to help me? The simple answer to this question is yes and no.   Often times an insurance adjuster will come across all sweet and nice on the phone making you think that they are working to help you out, but in reality, they are actually working against you trying to minimize your potential injury claim so that they can save their company as much money as they possibly can. Once they record your statement, you are locked into whatever it is that you say. Sometimes, people don’t remember every little detail from an accident and you are better off letting an attorney have that conversation with the insurance company representative. You might even say something that could be damaging to your claim and result in the insurance company putting a lesser value on the claim than it is actually worth. The very aggressive insurance companies will even go so far as to offer a monetary settlement shortly after an accident. They will send you a “Release Of All Claims” document to sign in exchange for a small amount of money. Once you sign that release, your case is over!! Be patient, and be smart. Always remember that the other driver’s insurance company is not on your side and that they are not your friend. They will play all kinds of games and use different techniques and tricks to minimize your claim and get you to settle for a low amount.  Hiring an attorney is the best way for you to make sure that insurance companies do not take advantage of you. They know that you have no idea what your case is worth and often times people don’t even know what they are entitled to. For example, if you are involved in an auto accident where the other party is at fault, the opposing insurance company will pay for a rental car while your car is being fixed. You can also be compensated for any time that you miss from work as a result of an accident. These are just two things that are compensable, but know that there are various other expenses that can also be recouped from the adverse party’s insurance company following an accident.  In conclusion, if you are involved in an automobile accident, be smart and consult with an attorney so that you do not do damage to your potential claim. If your toilet breaks, can you fix it yourself? Sure you can, but most people will immediately call a plumber to fix the toilet because that is what he does each and every day and he will know the best and the right way to fix it properly!
